Terms of Service

Welcome to Sawari Saathi. These Terms of Service ("Terms") govern your access to and use of the Sawari Saathi mobile application, website, and vehicle rental services (collectively, the "Service"). Please read these Terms carefully before using our platform.

By registering for an account or renting a vehicle through Sawari Saathi, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility and Account Registration

To rent a vehicle through Sawari Saathi, you must meet the following criteria:

• You must be at least 18 years of age (or older, depending on the specific vehicle category requirements).
• You must possess a valid, unexpired driver's license recognized by the Government of Nepal for the class of vehicle you intend to rent.
• You must create an account providing accurate, current, and complete identity and contact information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Vehicle Rental Conditions

When you rent a vehicle through our platform, you agree to the following conditions:

• Pre-Trip Inspection: You must inspect the vehicle before driving. Any existing damage must be reported through the app prior to starting your trip.
• Authorized Drivers: Only the registered user who booked the vehicle is authorized to drive it. Subleasing or allowing unregistered individuals to drive the vehicle is strictly prohibited.
• Prohibited Uses: Vehicles may not be used for illegal activities, racing, towing, off-roading (unless renting a designated 4x4 vehicle), or transporting hazardous materials.
• Geographic Limits: Vehicles must remain within the borders of Nepal unless explicit written permission is granted by Sawari Saathi.

3. Fares, Payments, and Fees

By confirming a rental, you agree to pay all associated fees, including:

• Rental Rates: Base daily or hourly rates as displayed in the app at the time of booking.
• Deposits: A refundable security deposit may be required before the vehicle is unlocked.
• Late Fees: Returning a vehicle later than the scheduled end time will incur late fees, calculated hourly, as well as potential inconvenience fees.
• Fuel Policy: Vehicles must be returned with the same amount of fuel as when they were picked up. Failure to do so will result in refueling charges plus an administrative fee.
• Tolls and Citations: You are fully responsible for any parking tickets, traffic violations, or toll fees incurred during your rental period.

4. Insurance and Liability

While Sawari Saathi ensures all vehicles maintain basic legal insurance coverage:

• Renter Responsibility: You are liable for any physical damage to the vehicle during your rental period, up to the maximum deductible amount specified in your booking agreement.
• Accident Reporting: In the event of an accident, you must notify local authorities immediately and report the incident to Sawari Saathi support within 24 hours.
• Personal Property: Sawari Saathi is not responsible for any personal property left in the vehicle during or after the rental period.

5. Cancellations and Refunds

You may cancel your reservation through the app. Our standard cancellation policy is as follows:

• Cancellations made at least 24 hours before the scheduled pickup time are eligible for a full refund.
• Cancellations made within 24 hours of the pickup time may be subject to a cancellation fee equivalent to one day's rental cost.
• No-shows will be charged the full amount of the initial booking period.

6. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, without notice, if we determine that you have violated these Terms, provided false information, or engaged in behavior that endangers our vehicles, staff, or the public.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
